Please read these Terms of Use carefully before accessing or using any part of the Zinaryex platform available at lopidey.pro. By accessing or using the platform, you confirm that you have read, understood, and agree to be bound by these terms. If you do not agree, you must not use the platform.
1. Definitions
Throughout these Terms of Use, the following terms carry the meanings defined below:
- Platform refers to the Zinaryex website, web application, and all associated services available at lopidey.pro.
- User refers to any individual or entity that accesses or uses the Platform.
- Account refers to the registered profile created by a User to access features of the Platform.
- Content refers to all text, materials, exercises, assignments, tools, and other resources made available through the Platform.
- Operator refers to Zinaryex, the entity responsible for operating and maintaining the Platform.
2. Eligibility
By using the Platform, you represent and warrant that you are at least 18 years of age, or that you are accessing the Platform under the supervision of a parent or legal guardian who agrees to these terms on your behalf. Users who do not meet these requirements are not permitted to use the Platform.
The Platform is intended for individuals seeking to develop practical skills in business automation through structured workshops and interactive exercises. Use of the Platform for any purpose outside of its intended scope is not permitted.
3. Account Registration and Security
3.1 Registration
Certain features of the Platform require you to create an Account. When registering, you agree to provide accurate, current, and complete information and to update it as necessary to keep it accurate.
3.2 Account Responsibility
You are solely responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your Account. You must notify the Operator immediately at contact@lopidey.pro if you suspect any unauthorised access to or use of your Account.
3.3 One Account Per User
Each User may maintain only one Account. Creating multiple Accounts to circumvent restrictions, access additional resources, or misrepresent identity is prohibited.
4. Permitted Use
Subject to these Terms of Use, the Operator grants you a limited, non-exclusive, non-transferable, and revocable right to access and use the Platform for your personal, non-commercial learning purposes.
You agree to use the Platform only in ways that are lawful and consistent with its intended educational purpose. You must not use the Platform in any manner that could damage, disable, or impair the Platform or interfere with any other User's experience.
5. Prohibited Conduct
When using the Platform, you must not:
- Copy, reproduce, distribute, or publicly display any Content without prior written authorisation from the Operator.
- Reverse engineer, decompile, or attempt to extract the source code of any part of the Platform.
- Use automated tools, bots, scrapers, or similar mechanisms to access, collect, or index Content.
- Upload or transmit any malicious code, viruses, or harmful data.
- Impersonate any person or entity or misrepresent your affiliation with any person or entity.
- Engage in any conduct that is harassing, abusive, defamatory, or otherwise harmful to other Users or the Operator.
- Attempt to gain unauthorised access to any part of the Platform, its servers, or related systems.
- Use the Platform to advertise, solicit, or promote any third-party product or service without the Operator's express written consent.
- Resell, sublicense, or otherwise commercialise access to the Platform or its Content.
6. Intellectual Property
6.1 Operator Content
All Content provided through the Platform, including but not limited to course materials, exercises, assignments, graphics, and software, is the exclusive property of the Operator or its licensors and is protected by applicable intellectual property laws. Nothing in these Terms of Use grants you any ownership rights in such Content.
6.2 User Submissions
If you submit, upload, or share any material through the Platform, including responses to exercises or collaborative contributions, you grant the Operator a non-exclusive, royalty-free, worldwide licence to use, store, and display that material for the purposes of operating and improving the Platform. You retain ownership of any material you submit.
6.3 Feedback
Any feedback, suggestions, or ideas you provide regarding the Platform may be used by the Operator without restriction or compensation to you.
7. Payments and Refunds
7.1 Fees
Certain features or workshops on the Platform may require payment. All applicable fees will be clearly presented before purchase. By completing a purchase, you agree to pay the stated amount.
7.2 Refund Policy
Refund eligibility is determined on a case-by-case basis in accordance with the Operator's refund policy in effect at the time of purchase. To request a refund, contact the Operator at contact@lopidey.pro within the applicable refund window.
7.3 Pricing Changes
The Operator reserves the right to modify pricing at any time. Price changes will not affect purchases already completed.
8. Third-Party Services and Links
The Platform may contain links to or integrations with third-party websites or services. These are provided for convenience only. The Operator does not endorse, control, or assume responsibility for the content, privacy practices, or terms of any third-party service. Your use of third-party services is governed entirely by their respective terms and policies.
9. Disclaimer of Warranties
The Platform is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. The Operator does not warrant that the Platform will be uninterrupted, error-free, or free of harmful components. To the fullest extent permitted by applicable law, the Operator disclaims all implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
The Operator does not guarantee any specific outcome, skill level, or result from participation in workshops or use of the Platform's educational materials.
10. Limitation of Liability
To the maximum extent permitted by applicable law, the Operator shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of or inability to use the Platform, even if the Operator has been advised of the possibility of such damages.
In no event shall the Operator's total liability to you for all claims arising from or related to the Platform exceed the total amount paid by you to the Operator in the twelve months preceding the event giving rise to the claim, or the equivalent of one hundred euros (€100), whichever is greater.
11. Indemnification
You agree to indemnify, defend, and hold harmless the Operator and its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Platform, your violation of these Terms of Use, or your infringement of any third-party rights.
12. Termination
12.1 By the Operator
The Operator reserves the right to suspend or terminate your Account and access to the Platform at any time, with or without notice, if you violate these Terms of Use or if the Operator determines that such action is necessary to protect the Platform, other Users, or the Operator's interests.
12.2 By the User
You may close your Account at any time by contacting the Operator at contact@lopidey.pro. Termination of your Account does not entitle you to any refund except as expressly provided in the refund policy.
12.3 Effect of Termination
Upon termination, your right to access the Platform ceases immediately. Provisions of these Terms of Use that by their nature should survive termination will continue to apply.
13. Modifications to These Terms
The Operator may update these Terms of Use from time to time. When changes are made, the updated version will be published on this page with a revised date. Your continued use of the Platform after the updated Terms of Use are posted constitutes your acceptance of the changes. If you do not agree with the revised terms, you must stop using the Platform.
14. Privacy
Your use of the Platform is also governed by the Operator's Privacy Policy, which is incorporated into these Terms of Use by reference. By using the Platform, you acknowledge that you have read and understood the Privacy Policy.
15. Availability and Maintenance
The Operator does not guarantee that the Platform will be available at all times. The Platform may be temporarily unavailable due to scheduled maintenance, technical issues, or circumstances beyond the Operator's control. The Operator will make reasonable efforts to minimise disruption and to communicate planned maintenance in advance where possible.
16. Entire Agreement
These Terms of Use, together with the Privacy Policy and any other policies or agreements expressly incorporated herein, constitute the entire agreement between you and the Operator regarding your use of the Platform and supersede all prior agreements or understandings relating to the same subject matter.
17. Severability
If any provision of these Terms of Use is found to be invalid, unlawful, or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, it will be severed from these terms. The remaining provisions will continue in full force and effect.
